Privacy Statement

The City of Rockingham (the City) collects, uses and discloses personal information in accordance with Council Policy – Privacy Management. This Policy is consistent with key provisions of the Privacy and Responsible Information Sharing Act 2024 (PRIS Act).

Personal information is collected by the City for the performance of local government functions and services, as otherwise authorised by law, and for supporting the ongoing research and development of the City’s functions and services.

Personal information includes but is not limited to:

  • name
  • contact details (address, telephone or email)
  • date of birth
  • bank account or financial details
  • government identifiers (i.e. drivers’ licence, pensioner concession card)
  • medical or health information
  • photographs or video footage.

It is collected in a variety of ways such as online, telephone, in-person, email, correspondence and forms, community consultation, CCTV or from third parties.

The City will take reasonable steps to provide you with information about the reason for collecting your personal information at the time of capture or as soon as practicable thereafter.

You do not have to provide all the personal information we request. However, if you choose not to, we may be unable to fully respond to your enquiry or process your request or application.

In many situations, the collection of personal information will be necessary for the City to perform its functions and services.

The City may use and disclose personal information for the primary purposes for which it was collected or when permitted to do so by law.

In some circumstances, it may also be used and disclosed for secondary purposes including:

  • where consent has been provided for the secondary use or disclosure
  • where a secondary use or disclosure is authorised or permitted by law
  • where the purpose of a secondary use or disclosure is related to the primary purpose (or, in the case of sensitive information, directly related to the primary purpose) and would be reasonably expected to be used for that purpose.

The City may disclose personal information to third parties including:

  • organisations or consultants undertaking community engagement and market research on behalf of the City
  • contractors that deliver goods, works and services on behalf of the City
  • public entities, under an information sharing agreement or information sharing request
  • local, state and federal government agencies and government trading enterprises that help the City to deliver functions and services
  • Western Australian Local Government Association (WALGA).

Personal information may be disclosed to interstate or overseas third parties where necessary to perform functions and services. Disclosure will only occur if consistent with Council Policy - Privacy Management or when required or authorised by law or court / tribunal order.

We collect CCTV video and still images for the purpose of surveillance and protection of staff, the community, and our assets.

CCTV footage includes the following in public areas, service areas and inside City buildings:

  • fixed CCTV cameras
  • mobile CCTV units
  • CCTV within City facilities
  • body worn cameras
  • mobile surveillance vehicles.

We may share your personal information with:

  • other government agencies for the purpose of law enforcement, or where the law allows or requires it
  • third parties for the purpose of an investigation
  • our service centres for operational purposes.

Reasonable steps are taken to protect personal information from misuse, loss, unauthorised access, modification, or disclosure. This includes implementing appropriate physical, technical, and administrative security measures.

You have a right to request access to personal information the City holds about you or apply to have your personal information corrected if the information is inaccurate, incomplete, out of date or misleading.

The City's Privacy Policy may be updated from time to time to reflect changes in practices or relevant laws. Any changes will be published on the website.

Website and Online Services

Every effort is made to keep the website up and running smoothly. However, the City of Rockingham takes no responsibility for and will not be liable for the website being temporarily unavailable due to technical issues beyond our control. 

When visiting the City’s website or one of its online services, the City logs a record of the user’s visit. The City records this information:

  • for statistical purposes
  • to monitor use of the website or online services
  • to discover what information is most and least used
  • to customise the site for users.

The information logged when users access the City’s website includes:

  • details of the server and internet provider users are accessing the City’s website from
  • details of user’s access of the City’s website
  • details of the operating systems, devices and software used to access the City’s website
  • details of the performance of user’s access of the City’s website
  • details of any other website, social media platform, code or link that directed the user to the City’s website.

The City will not identify a user or their browsing activities except for in the following circumstances:

  • to investigate improper use of the City’s Internet facility, a breach of the law, misconduct or corruption
  • where requested by a law enforcement agency.

Cookies are pieces of information or small files that the City’s website and online services sends to a user’s hard drive to record a user’s preferences when browsing a website or online service.

A cookie may remain on a user’s computer after the internet session finishes. The City’s website and online services use cookies for the following purposes:

  • security - to enable features that help detect security threats
  • customisation - to recognise returning users for measurement purposes and to better customise content to user preferences
  • verification - to verify users and tailor content for users who have an account or have logged into the City’s services
  • digital marketing and functionality - to record how users navigate the City’s website, including page views and usage data, and to customise content and deliver relevant digital communications. The City may use this data in conjunction with data received from other channels to share relevant advertisements.

Google Analytics and Google Optimize are services provided by Google, Inc. (Google).

When Google is used as a browser, Google Analytics uses cookies and tracking codes to help analyse how users use the City’s website. Google Optimize uses cookies to measure how different users respond to different content. The information generated is transmitted to and stored on servers in the United States.

The City will use Google Analytics and Google Optimize information to:

  • evaluate use of the City’s website and mobile site
  • receive reports for the City on website activity
  • provide other services relating to website activity and Internet usage
  • Google has their own privacy policies.

The City uses third party social media websites and applications to perform its functions. Each individual social media site and application has their own privacy policies.

The City’s website contains links to third party websites. Council Policy - Privacy Management does not apply if a user accesses a link and leaves the City’s website. The City is not responsible for services or information on third party websites.
